Καλώς ήλθατε στο ασύρματο δίκτυο (Wi- Fi) της Τεχνόπολης Δήμου Αθηναίων Α.Ε.. Η εταιρεία με την επωνυμία «της Τεχνόπολης Δήμου Αθηναίων Α.Ε.», που εδρεύει στην Ελλάδα, Πειραιώς 100, Αθήνα, 118 54 (εφεξής «Τεχνόπολης Δήμου Αθηναίων Α.Ε.» ή η «Εταιρεία»). Η παροχή των υπηρεσιών του ασύρματου δικτύου υπόκειται στην πολιτική, πρακτική και διαδικασίες της Εταιρείας. Η Εταιρεία δικαιούται, να προβεί σε τροποποίηση και/ή αναθεώρηση των παρόντων όρων κατά την απόλυτη διακριτική της ευχέρεια. ΠΕΡΙΕΧΟΜΕΝΑ: Ι. Γενικά ΙΙ. Τρόποι Σύνδεσης στο Ασύρματο Δίκτυο ΙΙΙ. Ασφάλεια και Ευθύνη ΙV. Εφαρμοστέο Δίκαιο- Λοιποί Όροι I. Γενικά Η σύνδεση παρέχεται ως έχει. ∆εν πηγάζει κανένα δικαίωμα και καμία απαίτηση προς τη Εταιρεία σχετικά με την παροχή αυτή. Η ταχύτητα πρόσβασης στο ασύρματο δίκτυο εξαρτάται από ποικίλους παράγοντες (το επιθυμητό σημείο πρόσβασης, την απόσταση από κάποιο κόμβο, τον αριθμό των χρηστών που είναι συνδεδεμένοι ταυτόχρονα, την τρέχουσα πραγματική ταχύτητα και τον φόρτο της γραμμής). Μέσω της υπηρεσίας ασύρματου δικτύου, προσφέρεται η δυνατότητα σύνδεσης στο διαδίκτυο, φορητών υπολογιστών και άλλων συσκευών χειρός που υποστηρίζουν συνδέσεις ασύρματου δικτύου, χωρίς τη χρήση καλωδίου δικτύου. II. Τρόπος Σύνδεσης στο Ασύρματο Δίκτυο Ο χρήστης μπορεί να χρησιμοποιήσει το ασύρματο δίκτυο αφού αποδεχτεί τους παρόντες όρους και αφού επιλέξει “Continue to the internet” (δυνατότητα στο τέλος των παρόντων όρων). Στην περίπτωση που ο χρήστης δεν επιθυμεί να αποδεχτεί τους παρόντες όρους χρήσης, δε δύναται να έχει πρόσβαση στο ασύρματο δίκτυο και να χρησιμοποιεί τις υπηρεσίες αυτού. Με την αποδοχή των όρων, ο χρήστης δηλώνει ότι είναι ηλικίας δέκα οχτώ (18) ετών και άνω. Σε κάθε άλλη περίπτωση, η Εταιρεία δε φέρει ευθύνη για τη χρήση αυτή. Με τον τρόπο αυτό, οι χρήστες αποκτούν πλήρη πρόσβαση στις υπηρεσίες του διαδικτύου. III. Ασφάλεια και Ευθύνη Κάθε χρήστης του ασύρματου δικτύου ευθύνεται και εξασφαλίζει ότι αυτό χρησιμοποιείται σύμφωνα με το ισχύον νομοθετικό καθεστώς, την καλή πίστη, τα συναλλακτικά και χρηστά ήθη. Ο χρήστης θα έχει την αποκλειστική ευθύνη για την ασφάλεια του συστήματος και του εξοπλισμού που χρησιμοποιεί για να μπορεί να έχει πρόσβαση στο διαδίκτυο μέσω του ασύρματου δικτύου, καθώς και για κάθε παράβαση, ή αναρμόδια χρήση τους ή γνωστοποίηση εμπιστευτικών πληροφοριών. Ενδεικτικά αναφέρεται ότι ο χρήστης οφείλει να μην παραβιάζει ειδικότερα τις διατάξεις του ισχύοντος νομοθετικού πλαισίου για την προστασία καταναλωτή, την πνευματική ιδιοκτησία, την προστασία προσωπικών δεδομένων (συμπεριλαμβανομένης της προστασίας προσωπικών δεδομένων στον τομέα των τηλεπικοινωνιών) και αντίστοιχες Οδηγίες και συστάσεις της Ευρωπαϊκής Ένωσης και άλλων διεθνών Οργανισμών κ.λ.π., όπως ισχύουν κάθε φορά. Περαιτέρω, ο χρήστης απαγορεύεται να διακινεί παράνομο και επιβλαβές περιεχόμενο, να τοποθετεί και αποστέλλει ϊομορφικά προγράμματα, να διακινεί πορνογραφικό και βίαιο περιεχόμενο, να επιδίδεται σε πράξεις που συνιστούν παράνομη πρόσβαση ή απόπειρα πρόσβασης σε υπολογιστικά συστήματα της Εταιρεία ή τρίτων, να προβαίνει σε μαζική αποστολή μη ζητηθείσης ηλεκτρονικής αλληλογραφίας για εμπορικούς ή μη σκοπούς (spamming) ή την παράλειψη πράξεων που απαγορεύουν την αποστολή spamming. Απαγορεύεται, ενδεικτικά κι όχι περιοριστικά, στο χρήστη να προβαίνει σε συκοφαντική δυσφήμηση προσώπων μέσω του Internet, κλοπές πνευματικής ιδιοκτησίας (ταινίες, λογισμικό, μουσική κ.α), παράνομη διακίνηση και πώληση προγραμμάτων (πειρατεία λογισμικού), διακίνηση υλικού παιδικής πορνογραφίας, εγκλήματα από hackers ή crackers (δικτυοπειρατεία), απάτες με πιστωτικές κάρτες, ξέπλυμα χρήματος, υπεξαίρεση χρημάτων, τρομοκρατία, αποστολή μηνυμάτων με παραπλανητικό περιεχόμενο, ώστε να εξαπατηθεί ο χρήστης και να αποκαλύψει στοιχεία πιστωτικών καρτών, κωδικούς τραπεζικών λογαριασμών, ηλεκτρονικούς εκβιασμούς (Cyberbullying), νιγηριανή απάτη, ηλεκτρονικές επιθέσεις, βιομηχανική κατασκοπεία, εισβολές σε στρατιωτικούς κόμβους ή σε υπολογιστικά συστήματα τραπεζών (δικτυοπειρατεία), τηλεπικοινωνιακές απάτες μέσω υπολογιστών, υποκλοπές ηλεκτρονικής αλληλογραφίας, επίθεση στην ιστοσελίδα μιας εταιρείας ή μιας υπηρεσίας ή ενός οργανισμού, ώστε να μην λειτουργεί καθόλου ή να μην λειτουργεί σωστά. Επίσης, απαγορεύεται, ενδεικτικά κι όχι περιοριστικά, στο χρήστη να προβαίνει σε εγκατάσταση προγραμμάτων-κατασκόπων (spyware) στον υπολογιστή ενός χρήστη ώστε να παρακολουθούνται και να καταγράφονται οι κινήσεις και οι επιλογές του, για στατιστικούς ή και άλλους κακόβουλους λόγους, όπως εμπορευματοποίηση των προσωπικών του δεδομένων ή των καταναλωτικών του συνηθειών κ.α. Επίσης, ο χρήστης οφείλει να συμμορφώνεται με την εκάστοτε δημοσιοποιούμενη πολιτική χρήσης των υπηρεσιών και του Ασύρματου Δικτύου της Εταιρεία .Για τον λόγο αυτό θα πρέπει να γίνεται προσεκτική χρήση των υπηρεσιών του διαδικτύου. Επίσης η σύνδεση κάθε χρήστη είναι αυστηρά προσωπική και απαγορεύεται η παροχή με οποιοδήποτε τρόπο υπηρεσιών διαδικτύου σε τρίτους. Σε περίπτωση που η Εταιρεία ζημιωθεί με οποιοδήποτε τρόπο από πράξεις ή παραλείψεις του χρήστη, ο τελευταίος υποχρεούται να αποκαταστήσει κάθε ζημία του και η Εταιρεία. δικαιούται να τον καλεί ως δικονομικό εγγυητή στις σχετικές διαδικασίες. Ο χρήστης αναγνωρίζει ότι το διαδίκτυο είναι ανοικτό περιβάλλον, ότι αυτός είναι υπεύθυνος για την τήρηση των προσωπικών στοιχείων του, ότι οφείλει να ενεργεί με υπερβολική επιμέλεια παίρνοντας τα αναγκαία μέτρα ασφάλειας, για να αποτρέπει την παράνομη χρήση του δικτύου από τρίτα εξουσιοδοτημένα ή μη πρόσωπα. Οφείλει να απομνημονεύει τα στοιχεία του προσωπικού του λογαριασμού, να μην τον αναγράφει σε αντικείμενα που μεταφέρει ή καθιστά προσιτά σε τρίτους, ούτε να επιτρέπει τη χρήση των κωδικών του στοιχείων από άλλουςΛόγω της φύσης του ασύρματου δικτύου, ο χρήστης θα πρέπει να αποφεύγει την αποστολή προσωπικών δεδομένων ευαίσθητης φύσης (PIN, αριθμούς πιστωτικών καρτών, κωδικούς πρόσβασης κλπ.) χωρίς να είναι ενεργοποιημένο το αντίστοιχο πρωτόκολλο ασφαλείας (https , ftps κλπ.). Με την είσοδό του στο ασύρματο δίκτυο, ο χρήστης αποδέχεται ότι ανήκει σε ένα κοινό δίκτυο με άλλους χρήστες και για το λόγο αυτό θα πρέπει να δίνει ιδιαίτερη προσοχή στους φακέλους και τα αρχεία που έχει κοινόχρηστα. Επιπλέον συνιστάται η εγκατάσταση ενός firewall στον Η/Υ του χρήστη. Τεχνική υποστήριξη ∆ΕΝ παρέχεται από την Εταιρεία. Η Εταιρεία δε φέρει οποιαδήποτε ευθύνη για οποιαδήποτε ζημιά και/ή βλάβη τυχόν υποστεί ο χρήστης και/ή οποιοσδήποτε τρίτος από την προσωρινή και/ή μόνιμη διακοπή του ασύρματου δικτύου. Η Εταιρεία δεν εγγυάται ότι η παροχή του ασύρματου δικτύου θα είναι συνεχής, έγκαιρη, ασφαλισμένη, χωρίς λάθη ή ότι το ασύρματο δίκτυο θα είναι διαθέσιμο καθ’ οιονδήποτε χρόνο. Η Εταιρεία δεν φέρει οποιαδήποτε ευθύνη σε περίπτωση που ο χρήστης χρησιμοποιεί το Ασύρματο Δίκτυο κατά τρόπο προσβλητικό, καταχρηστικό, άτιμο, άσεμνο, ενοχλητικό και γενικά καθ’ οιονδήποτε τρόπο ο οποίος αντίκειται στα χρηστά ήθη και/ή στην νομοθεσία και/ή παραβιάζει τα δικαιώματα οποιουδήποτε τρίτου. Η Εταιρεία δεν φέρει οποιαδήποτε ευθύνη για την πλοήγηση του χρήστη σε οποιοδήποτε περιεχόμενο και/ή ιστοσελίδα και/ή διαφήμιση οποιουδήποτε τρίτου μέσω του ασύρματου δικτύου της. ΙV.Εφαρμοστέο Δίκαιο- Λοιποί όροι Για την επίλυση οποιασδήποτε διαφοράς προκύπτει μεταξύ της Εταιρεία και των χρηστών σχετικά με τη χρήση του ασύρματου δικτύου ή σε σχέση με τα παραπάνω, αρμόδια είναι τα δικαστήρια των Αθηνών και εφαρμοστέο δίκαιο το Ελληνικό, χωρίς όμως να λαμβάνονται υπόψη οι κανόνες σύγκρουσής του. Σε περίπτωση που κάποια διάταξη των παρόντων ακυρωθεί με απόφαση δικαστηρίου ως μη νόμιμη, έγκυρη και εκτελεστή, ή θεωρηθεί μη εφαρμόσιμη, το γεγονός αυτό δε θα επηρεάζει το υπόλοιπο των διατάξεών των όρων, οι οποίες θα παραμένουν σε ισχύ και θα εφαρμόζονται κανονικά. Οι όροι αυτοί αντιπροσωπεύουν τη συνολική συμφωνία μεταξύ του κάθε χρήστη και της Εταιρεία και διέπουν την πρόσβαση και τη χρήση του ασύρματου δικτύου από την πλευρά των χρηστών και υπερισχύουν κάθε άλλης γραπτής συμφωνίας μεταξύ του κάθε χρήστη και της Εταιρεία σε σχέση με τη χρήση του ασύρματου δικτύου. Οι όροι αυτοί ερμηνεύονται σύμφωνα με το Ελληνικό Δίκαιο. Terms and Conditions of the use of the Wireless Network (Wi- Fi) of Technopolis City of Athens Welcome to the wireless network (Wi-Fi) of Technopolis City of Athens. The company “Technopolis City of Athens” having its registered office at 100 Peiraios Str, in Athens, Greece, 11854 (hereinafter referred to as “the Company”). The provision of wireless network services is subject to the policy, practice and procedures of the Company. The Company has the right to amend and review the current terms and conditions under its absolute certain discretion. INDEX Ι. General ΙΙ. Ways to Connect to the Wireless Network ΙΙΙ. Security and Liability ΙV. Applicable Law- Other Terms I. General The connection is provided by the Company unchanged. No rights and requirements arise for the Company regarding this provision. The speed of access to the wireless network depends on multiple factors (the desired access point, the distance from a hub, the number of users that are connected at the same time, the current actual speed and the load on the line).Via the connection to the Wi-Fi network, you can connect to the Internet with your laptop and other portable devices that support Wi-Fi connections without the use a network cable. II. Ways to Connect to the Wireless Network The user can use the wireless network after accepting the current terms and conditions and after selecting “Continue to the internet” (option at the end of the terms and conditions). In case that the user does not wish to accept the current terms and conditions, the access to the wireless network and the use its services are not possible. By accepting the terms, the user indicates that he/she is eighteen (18) years old or older. In any other case, the Company is not responsible for this use. In so doing, the users gain full accessibility to the network services. III. Security and Liability Every user of the wireless network is responsible and reserves that the network will be used in accordance to the existing legal framework, the good faith and the honest practices. The user shall be exclusively responsible for the system’s security and the equipment that he/she is using in order to access the internet through the wireless network, as well as for every violation, unauthorized use or disclosure of confidential information. By way of illustration, it is stated that the user must not violate any of the provisions of the existing legal framework for the protection of the consumer, the intellectual property, the protection of personal data (including the protection of personal data in the telecommunication sector) and relevant regulations and recommendations issued by the European Union and other International Organizations etc, as they apply every time. Furthermore, channeling illegal and harmful content, launching and sending malware programs, channeling pornographic and violent content, engaging in illegal access or attempts to access the software of the Company or third parties, proceeding in mass sending of non-desired emails for commercial or other reasons (spamming) or in omission of actions that prohibit spamming, by the user is prohibited. It is prohibited- indicatively and not exhaustively- for the user to commit slanderous defamation of persons through the internet, theft of intellectual property (movies, software, music etc), trafficking and sale of programs illegally (software piracy), trafficking of child pornography material, crimes by hackers or crackers (hacking), scams with credit cards, money laundering, misappropriation of funds, terrorism, sending messages with misleading content in order to trick the user into sharing credit card information, bank accounts’ passwords, cyberbullying, Nigerian fraud, cyber attacks, industrial espionage, attacks on military nodes or banking systems (hacking), telecommunication frauds through computers, illegal interception of emails, attack to a company’s webpage or service or organization to disable its function completely or partially. Moreover, it is prohibited, indicatively but shall not be limited, to proceed to the installation of spyware to one’s computer, to monitor and write down moves and choices, for statistic or other spiteful reasons, like the commercialization of personal information or consumer habits etc. Additionally, the user must comply with the published user policy of the services and the Wireless Network of the Company. For this reason, the network services must be used cautiously. Furthermore, the connection of each user is strictly personal and the provision of network services to third parties in any way is prohibited. In case that the Company is damaged in any way from the actions or omissions of the user, the latter is responsible to repair any damage and the Company has the right to call him as a procedural guarantor in the relevant proceedings. The user recognizes that the internet is an open environment, that he/she is responsible for the preservation of his/her personal information, that he/ she must act with extreme diligence by taking the required safety measures, in order to prevent the illegal use of the network by third authorized or unauthorized persons. He/She must memorize the details of his personal account, to not write them down on objects that he/she carries or that can be accessed by third parties, neither to allow the use of his passwords by others. Having regard to the nature of the wireless network, the user will have to avoid the sending of personal information of a sensitive nature (PIN, credit card numbers, passwords etc.) without activating the corresponding security protocol (https, ftps etc.). With his entry into the wireless network, the user is agreeing to be a part of a common network with other users and for this reason particular attention should be given to the folders and the documents that are shared. In addition, the installation of a firewall on the computer of the user is recommended. Technical support is NOT provided by the Company. The Company is not responsible for any damage the user and/or any third party might undergo from the temporary and/or permanent interruption of the wireless network. The Company does not guarantee that the provision of the wireless network will be continuous, timely, secured, without flaws or that the wireless network will be available at any time. The Company is not responsible in the case that the user uses the Wireless Network in an offensive, abusive, dishonest, obscene, disturbing way and generally in any way that contradicts to the ethics and/or to the legislation and/or breaches the rights of any third party.The Company is not responsible for the navigation of the user in any context and/or webpage and/or advertisement of any third party through its wireless network. ΙV. Applicable Law- Other Terms For the resolution of any dispute between the Company and its users regarding the use of the wireless network or in accordance with the above, the courts of Athens are competent and the Greek law is applicable, without taking into consideration its rules of conflict. In case any provision of the above is cancelled with a judicial ruling as not legal, valid and capable, or is considered impracticable, this fact shall not affect the rest of the provisions of the conditions, which will remain in force and will normally apply. Those terms and conditions represent the comprehensive agreement between each user and the Company and govern the access and the use of the wireless network from the side of the users and supersede any other written agreement between each user and the Company regarding the use of the wireless network. These terms are interpreted in accordance with the Greek Law.
